Terms and Conditions

We encourage you to read and understand these Terms and conditions to make sure that you understand, acquainted with the terms and conditions governing use of the Website/Application before using the services provided through the Platforms. Also, check this page frequently to keep up with the amendments to these Terms.

THESE TERMS AND CONDITIONS (“Terms”) ARE EFFECTIVE FROM: 03/12/2020

THIS IS AN AGREEMENT BETWEEN YOU OR THE ENTITY THAT YOU REPRESENT (hereinafter referred to as “You” or “Your”) AND CRAYONS EDUCATION PVT LTD,GOVERNING YOUR USE OF A/L KUPPIYA, (hereinafter referred to as “Website/Application” or “we”) WHICH INCLUDES SIX PRODUCT, NAMELY, KUPPIYA VOD, KUPPIYA LIVE, KUPPIYA STORE, A/L SQUAD, TUITION HANDIYA AND AFTER A/L’.  

  1. ACCEPTANCE OF THE TERMS

You must be of legal age to enter into a binding agreement in order to accept the Terms. If you have not attained the age of majority, we hope that you will use the Website/Application and make any payments under the supervision of your guardian.

If you do not agree to the Terms, do not use any of our Services. By using our Website/Application, you indicate that you accept these terms and conditions, and the Privacy Policy. You shall abide by these terms and the laws of the Democratic Socialist Republic of Sri Lanka.

Lecturers registered with us shall be governed by the Terms and Conditions stated on the Agreements signed with us other than Terms and Conditions stated herein.

  • DESCRIPTION OF SERVICE

A/L Kuppiya is a multifunctional educational platform, which provides educational content to facilitate students studying for G.C.E (A/L) Examination. The Website shall be accessible through the URL www.alkuppiya.lk. Also, users (any person uses the platforms, including teachers and students) can access the services through the Desktop App and the Mobile App, which can be downloaded through the website. 

The Website/Application offers six different services: 

Kuppiya Live

This platform is for Lectures/Teachers to conduct classes for students using online facilities (based on Zoom application).

Users shall pay the prescribed fee for the corresponding class. Please note that no funds shall be refunded for any reason. Enrolled students have facility to watch the recorded live session without any extra fee.

The correctness of the content taught and the teaching method are solely the responsibility of the relevant Lecture/teacher.

Users shall not use language or behave in unlawful, defamatory, harassing, libelous, abusive, threatening, harmful, vulgar, pornographic, obscene, or is otherwise objectionable, offends religious sentiments, promotes racism, contains viruses or malicious code, or that which infringes or may infringe intellectual property or other rights of another.

Users shall not copy, download, screen record or distribution of live class sessions, without our prior written approval.

Kuppiya VOD

This platform provides recorded A/L Lessons prepared by Crayons Education Pvt Ltd with qualified Lecturers/teachers.

Users shall pay the prescribed fee for the corresponding video. Please note that no funds shall be refunded for any reason.

The Purchase shall be only available for viewing up to three (03) days from the date on which payment was made. After three days users are required to purchase the same video again for viewing. Any corresponding reading material or attachments shall be available for no extra fee.

The correctness of the content taught and the teaching method are solely the responsibility of the relevant Lecture/teacher.

All the content available on this platform is owned by Crayons Education Pvt Ltd, and users shall abstain from copying, downloading, screen recording or distributing, without our prior written approval.

Users shall not use language which is defamatory, harassing, libelous, abusive, threatening, harmful, vulgar, pornographic, obscene, or is otherwise objectionable, offends religious sentiments, promotes racism, contains viruses or malicious code, or that which infringes or may infringe intellectual property or other rights of another, when commenting for any video.

Kuppiya Store

We may list different items to be sold on this platform. Users shall purchase any item for the prescribed fixed prices.

It shall be the duty of the users to read the complete description on the item before purchasing, and purchase the correct item.

Users will be able to complete the payments through the online payments or cash on delivery. It shall be the duty of the users to provide a correct details required for online payments and cash on delivery.

Tuition Handiya

Free and paid advertisements will be published mainly on the Advance Level Examination tuition classes.

Any person can publish advertisements on this platform, and to publish advertisements, please feel free to contact us. 

It shall be the duty of users to ensure on the correctness and reliability of the advertisements.

The phone number and domain names, may direct users to other websites and other platforms or other medium of communication. We take no responsibility on the content and any transactions conducted thereafter.   

A/L Squad Eka

Free Service

Users shall on this, online student community developed for students, post their thoughts, share documents, ask questions, etc.

Users shall not use language which is unlawful, defamatory, harassing, libelous, abusive, threatening, harmful, vulgar, pornographic, obscene, or is otherwise objectionable, offends religious sentiments, promotes racism, contains viruses or malicious code, or that which infringes or may infringe intellectual property or other rights of another, when using this platform.

After A/L’s

Free service, that offers details about the after A/L courses, opportunities and occupations.

All content shall be published by the company, and users may request more information through the inquiry console or relevant inquires directed to corresponding institutes / companies.

The phone number and domain names, may direct users to other websites and other platforms or other medium of communication. We take no responsibility on the content and any transactions conducted thereafter. 

  • MODIFICATION OF TERMS OF SERVICE

We reserve the right to amend this Terms of Service at any time and amended terms will be effective from the date mention on the top of these Terms.

We may modify the Terms upon notice to you at any time through a service announcement or by sending email to your primary email address.

Any significant changes to the Terms that affect your rights, you will be notified an advance notice of the changes by email to your primary email address.

Your continued use of the Website/Application after the effective date of any change to the Terms will be deemed to be your agreement to the modified Terms.

  • USER SIGN UP OBLIGATIONS

You are required to sign up for a user account by providing all required information in order to access or use the Services. Also, you may login through the Facebook and Google Account too. However, please note that when using the Facebook and Google account we will not collect your password.

You shall provide: true, accurate, current and complete information about yourself as prompted by the sign up process, and  maintain and promptly update the information provided during sign up to keep it true, accurate, current, and complete.

If you provide any information that is untrue, inaccurate, outdated, or incomplete, or if we have reasonable grounds to suspect that such information is untrue, inaccurate, outdated, or incomplete, we reserve the right to suspend or terminate your user account and refuse current or future use of any or all of the Services provided through all platforms.

Every account is a personal account and, users cannot register for more than one account without our expressed consent in writing. Users may never use another person’s user account or registration information.

Also, we reserve the right to suspend or terminate your account, in any breach of the law or these Terms or we believe that your actions may cause any loss or liability to our users or to us and refuse current or future use of any or all of the Services provided through all platforms.

PLEASE NOTE that you are solely responsible to keep the password and username secured, and for any activity that occurs on your account you will be responsible, unless it is a result of actions beyond your control. Further, we emphasize that, we are not responsible for your account administration, use of the account and any harm incurred to you or any other third party due to your failure to secure your account password and username. 

You shall inform us immediately of any unauthorized use of your user account by email to [email protected].

  • PERSONAL INFORMATION AND PRIVACY

Personal information you provide through the platform is governed by our Privacy Policy.  [U1] Your election to use the Service indicates your acceptance of the terms of the Privacy policy.  

  • COMMUNICATIONS FROM A/L KUPPIYA.LK

The Service may include certain communications from us, such as service announcements, administrative messages and other communications. You understand that these communications shall be considered part of using the Services provided by us.

We provide you the option of opting-out from receiving communications from us. However, we encourage not opt-out.

  • USER CONTENT

PLEASE NOTE that we may remove; edit and modify comments and contents shared by students. However, please note that we shall have no duty to supervise remove; edit and modify comments any content.

  • FEES AND REFUNDS

The Website/Application offers free services as well as paid services. You shall be required to complete the payment before accessing any content offered for a payment. 

Payments can be made only by credit card or debit cards through Payhere or pay with SLT. PLEASE NOTE that these platforms are not governed by this Terms or our Privacy policy. These companies have their own term and policies. We encourage you to read them before using the payment services provided by them.

We reserve the right to change the price of any Service/content that we provide for money or charge for use of Services that are currently available free of charge. Any decision regarding the fee and charges shall be strictly abide by the users and any decision taken by the company shall be final and conclusive.

We may or may not notify the users of any changes regarding price changes as immediately as possible and any price changes will not be effective retrospectively.

We do not refund any payment for any reason. In the event of suspension or termination of your account any payment that has been already paid will not be refunded. For any issue regarding payments please contact us via [email protected].

  • RESTRICTIONS ON USE

In addition to all other terms and conditions of this Agreement, you shall not:

  • Transfer the Services or otherwise make it available to any third party;
  • Provide any service based on the Services without prior written permission;
  • Post links to third party sites or use their logo, company name, etc. without their prior written permission;
  • Publish any personal or confidential information belonging to any person or entity without obtaining consent from such person or entity;
  • Use the Services in any manner that could damage, disable, overburden, impair or harm any server, network, computer system, resource of Crayons Education PVT LTD or any third party;
  • Violate any applicable local, state, national or international law;
  • Create a false identity to mislead any person as to the identity or origin of any communication; and
  • Use any abusive language or comment within the platform;  
  1. ILLEGAL ACTIVITIES

You agree to be solely responsible for the contents of your share/transmit through the Services. You agree not to use the Services for illegal purposes or for the transmission of material that is unlawful, defamatory, harassing, libelous, invasive of another’s privacy, abusive, threatening, harmful, vulgar, pornographic, obscene, or is otherwise objectionable, offends religious sentiments, promotes racism, contains viruses or malicious code, or that which infringes or may infringe intellectual property or other rights of another.

  1. INTELLECTUAL PROPERTY

The Intellectual property rights of all content made available or uploaded by the Lecturers shall be decided as the Intellectual Property clause stated on the respective Agreement. The Intellectual property of any other content shared through platform/uploaded to the platform shall be owned by the creators of such content, unless otherwise agreed with us. 

However, we may use with your approval or without any approval, content shared through platform/uploaded to the platform. Your use of the Services shall indicate that a license has been granted to use, reproduce, adapt, modify, publish or distribute the content created by you commercial, marketing or any similar purpose.

Your use of the Services shall indicate you shall also grant us permission to access, copy, distribute, store, transmit, reformat, publicly display and publicly perform the content of your user account as required for the purpose of providing the Services to you.

All rights, title, and interest in and to the six platforms and Services, including Website/Application, our existing or future applications, databases, and the content our employees or partners submit or provide through our Services (unless otherwise expressly recognized by us) are and will remain the exclusive property of by Crayons Education Pvt Ltd and its licensors.

Any feedback, comments, or suggestions you may provide regarding the platforms or the Services is entirely voluntary and we will be free to use such feedback, comments, or suggestions as we see fit and without any obligation to you.

  1. TRADEMARK

A/L kuppiya and the logo is a registered trademark own by Crayons Education Pvt Ltd. You agree not to display or use, in any manner, the a/l kuppiya trademarks, without our prior permission.

Further, you shall not use our name domain names, other distinctive brand features or names of the platforms or logos of any of our platforms without our prior permission.

  1. DISCLAIMER

YOU EXPRESSLY UNDERSTAND AND AGREE THAT THE USE OF THE SERVICES IS AT YOUR SOLE RISK. THE SERVICES ARE PROVIDED ON AN AS-IS-AND-AS-AVAILABLE BASIS. CRAYONS EDUCATION PVT LTD EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. CRAYONS EDUCATION PVT LTD MAKES NO WARRANTY THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE. USE OF ANY MATERIAL DOWNLOADED OR OBTAINED THROUGH THE USE OF THE SERVICES SHALL BE AT YOUR OWN DISCRETION AND RISK AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOU OR YOUR COMPUTER SYSTEM, MOBILE TELEPHONE, WIRELESS DEVICE OR DATA THAT RESULTS FROM THE USE OF THE SERVICES OR THE DOWNLOAD OF ANY SUCH MATERIAL. NO ADVICE OR INFORMATION, WHETHER WRITTEN OR ORAL, OBTAINED BY YOU FROM CRAYONS EDUCATION PVT LTD ITS EMPLOYEES OR REPRESENTATIVES SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TERMS.

LECTURERS WHO CONDUCT ONLINE CLASSES OR UPLOAD CONTENT SHALL BE SOLELY RESPOSNSIBLE FOR THE CORRECTNESS OF THE CONTENT UPLOADED OR LESSONS TAUGHT THROUGH THE ONLINE PLATORM. UNDER ANY CIRCUSTANCES CRAYONS EDUCATION PVT LTD MAKES NO WARRANTY IMPLIED OR EXPRESSED AS TO THE CORRECTNESS OF THE CONTENT UPLOADED OR LESSONS TAUGHT THROUGH THE ONLINE PLATORM.

THOUGH, WE MAY TRY TO REMOVE ANY OFFENSIVE, INDECENT OR OBJECTIONABLE CONTENTS ON THE PLATFORMS.  BY USING THE SERVICES, YOU MAY BE EXPOSED TO CONTENT THAT YOU CONSIDER OFFENSIVE, INDECENT, OR OBJECTIONABLE. WE HAVE NO RESPONSIBILITY TO KEEP SUCH CONTENT FROM YOU AND NO LIABILITY FOR YOUR ACCESS OR ENROLLMENT IN ANY COURSE.

PLEASE NOTE THAT THERE MAY BE LINKS, URL CODES AND NUMBERS WHICH MAY DIRECT YOU TO OTHER WEBSITES. WE TAKE NO RESPONSIBILITY REGARDING THE CONTENT ON OTHER WEBSITES. YOU MAY PROCEED AT YOUR OWN RISK. 

WE RESERVE THE RIGHT TO CEASE MAKING AVAILABLE CERTAIN FEATURES OF THE SERVICES AT ANY TIME AND FOR ANY REASON.

  1. LIMITATION OF LIABILITY

YOU AGREE THAT CRAYONS EDUCATION PVT LTD SHALL, IN NO EVENT, BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, INDIRECT, SPECIAL, PUNITIVE, OR OTHER LOSS OR DAMAGE WHATSOEVER OR FOR LOSS, COMPUTER FAILURE, LOSS OF BUSINESS INFORMATION, OR OTHER LOSS ARISING OUT OF OR CAUSED BY YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF CRAYONS EDUCATION PVT LTDHAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. IN NO EVENT SHALL CRAYONS EDUCATION PVT LTD’S ENTIRE LIABILITY TO YOU IN RESPECT OF ANY SERVICE, WHETHER DIRECT OR INDIRECT, EXCEED THE FEES PAID BY YOU TOWARDS SUCH SERVICE.

  1. INDEMNIFICATION

You agree to indemnify and hold harmless Crayons Education PVT LTD, its officers, directors, employees, suppliers, and affiliates, from and against any losses, damages, fines and expenses (including attorney’s fees and costs) arising out of or relating to any claims that you have used the Services in violation of another party’s rights, in violation of any law, in violations of any terms herein provided, or any other claim related to your use of the service provided through the Website/Application.  

  1. DISPUTE

You shall make a good-faith effort to resolve any disagreement arising out of, or in connection with, these Terms through negotiation. If the parties fail to resolve, any controversy or claim arising out of or relating to the Terms shall be settled by binding arbitration in accordance with the Arbitration Act No. 11 of 1995.

  1. SUSPENSION AND TERMINATION

We may suspend your user account or temporarily disable access to whole or part of any Service in the event of any suspected illegal activity, or requests by law enforcement or other government agencies.

Any Objections to suspension or disabling of user accounts should be made to [email protected]  s within thirty days of being notified about the suspension.

  1. CONFIDENTIALITY

You shall agree and  acknowledge that you may have access to certain information and materials, including the these terms, concerning the business, clients, business writings, employees information, business technologies that we use, products and services of the other party, that are business secrets and confidential information.

You shall note except with your prior permission, replicate, reproduce, use, share, and disclose to any other third-party any Confidential Information or business secrets.

You shall return to us or destroy the business secrets or Confidential Information promptly upon our written request or at the time of terminating the use of services provided by us through the platform.

  1. SURVIVABILITY

The obligations and liabilities incurred by you prior to the termination, suspension shall survive the termination of these Terms of Service for all purposes.

  • RELATIONSHIP

You shall agree that no joint venture, partnership, employment, contractor, or agency relationship exists between Crayons Education Pvt Ltd and You.

  • ASSIGNMENTS

You may not assign any of your rights under these Terms of Service to anyone else. We may assign our rights to any other individual or entity at our discretion.

  • FORCE MAJEURE

The failure or delay of us in the performance of any part of the Service, for any reason beyond our control, which includes, but not limited to, acts of God, severe weather conditions, floods, earthquakes, embargoes, war, terrorist acts, riots, fires, nuclear accidents, strikes, power blackouts, volcanic action shall not amount to a violation of these Terms.

  • GOVERNING LAW

These Terms of Service shall be governed by and construed in accordance with the laws of the Democratic Socialist Republic of Sri Lanka.

The courts of Colombo, Democratic Socialist Republic of Sri Lanka shall be the competent jurisdiction to institute any legal action pertaining to this Terms or any other matter pertaining thereto.

  • SEVERABILITY

If any clause of these Terms of Services is unenforceable, then the rest of the Terms of Services will still be valid.

  • NON-WAIVER

The failure of us to enforce any right, power or privilege provided under these Terms of Service shall not constitute a waiver of such right or provision. All waivers by us will be contained in a written instrument signed by us.

  • CONFLICT

Any version of these Terms in a language other than English is provided for convenience and you understand and agree that the English language shall prevail if there is any conflict.

  • NOTICES
